Freeserve don't give up...

Even following their recent defeat Freeserve are still continuing their quest to prove that BT's broadband has been anti-competitively priced.
Freeserve have announced that they plan to bring in the Competition Appeal Tribunal (CAT), which is the UK's highest competition court.

"It is clear that we disagree with a number of the key assumptions and conclusions in the decision, which we believe is fundamentally flawed on factual, legal and methodological bases.
"Given the importance of achieving sustainable competition in the broadband market we believe it in the interests of all parties involved that clarity and certainty is brought to this area as soon as possible and will be looking to get the Appeal filed with the CAT at the earliest opportunity." |

Freeserve put the blame firmly on Oftel for the delayed and drawn-out action, as the dispute enters into it's third year.

fundamental flaws in their application of competition law back then. However, this is the first time Oftel has actually shared its in-depth methodology with Freeserve," |

A BT insider had a different take on the matter.
"Frankly, Freeserve are bad losers," he said. And you can't really argue with that!!
